TERMS & CONDITIONS — BOOKINGS, SALES & PARTICIPATION

These Terms & Conditions (“Terms”) govern any booking, purchase or participation with KGOGO Arts & Gallery (“KGOGO”, “we”, “us”). By booking, purchasing, or attending any KGOGO experience or purchasing artwork, you agree to these Terms.

1. Eligibility

Participants in NDIRI PANO and most KGOGO experiences must be 18 years or older. By booking you confirm that you meet the age requirement and have the legal capacity to enter into these Terms.

2. Booking, confirmation and payment

Bookings are confirmed only once full payment or the specified non-refundable deposit has been received. Payment is processed by third-party payment providers. KGOGO is not responsible for payment-processor outages or delays.

Prices displayed at booking are final for the currency shown. Any bank or currency conversion fees are the customer’s responsibility.

3. Identity verification and KYC

For booking validation and safety, KGOGO may require participants to upload government-issued identification documents through our secure booking verification channel. ID uploads are processed only for verification and record-keeping in accordance with our Privacy Policy and AML Policy.

4. Cancellation and rescheduling

Customer cancellations: Full refund for cancellations made at least seven (7) full days before the scheduled experience. Cancellations received less than seven (7) days before the experience may be non-refundable or subject to the cancellation fee stated at booking.

Rescheduling: Rescheduling is permitted subject to availability and any applicable fees.

Provider cancellations: If KGOGO cancels due to safety, weather, government order, or other operational reasons, KGOGO will offer alternative dates or a full refund.

5. Health and safety

Participants must disclose any medical conditions, disabilities, pregnancy or other health matters relevant to participation at booking. KGOGO may request medical clearance if necessary. KGOGO has qualified EMS personnel on site for NDIRI PANO.

Participants must follow all safety instructions provided by KGOGO staff and national park authorities.

6. Assumption of risk, release and waiver

To the full extent permitted by law, you acknowledge and agree:

Participation in outdoor experiences carries inherent risks (weather, wildlife, footing, travel). You assume all such risks.

You release KGOGO, its officers, agents, employees, contractors and partners from liability for personal injury, loss or damage, except where due to KGOGO’s gross negligence or willful misconduct.

7. Limitation of liability

KGOGO’s total liability for claims arising under these Terms is limited to the amount paid by the participant for the relevant booking or purchase. KGOGO is not responsible for indirect, consequential, special or punitive damages.

8. Indemnity

You will indemnify and hold KGOGO and its representatives harmless from any claim, loss, damage or expense (including legal fees) arising from your breach of these Terms, your negligence or any third-party claim caused by your acts or omissions.

9. Code of conduct, photography and recording

Participants must behave respectfully toward staff, other guests, local communities and the environment. Abusive or dangerous behaviour may result in immediate removal without refund.

No recording or photography is permitted during NDIRI PANO unless explicit written consent has been obtained. All personal devices must be switched off for the duration of the experience.

10. Collector Keys, certificates and resale

KGOGO issues a limited series of 144 golden Keys as Certificates of Authenticity for NDIRI PANO participation. Ownership of a Key confers the specific rights and privileges set out at the point of sale.

Keys are transferable only in accordance with KGOGO resale policies. KGOGO may require notification of resale, provenance verification, and may apply an authenticity validation fee and artist royalties.

11. Force majeure

KGOGO is not liable for failure to perform caused by events beyond reasonable control (natural disasters, strikes, pandemics, government restrictions, national park closures). KGOGO will attempt to reschedule or provide refunds where appropriate.

12. Data protection

KGOGO processes personal data in accordance with its Privacy Policy. By booking you consent to the collection and use of your data for legitimate booking, safety and administrative purposes.

13. Governing law and disputes

These Terms are governed by the laws of Zimbabwe. Any disputes should first be referred to KGOGO for good-faith resolution. If unresolved, disputes may be referred to the courts of Zimbabwe.

14. Severability and amendments

If any provision of these Terms is held invalid, the remaining provisions continue in full force. KGOGO may update these Terms; the most recent version on our website governs all bookings made after the date of update.
